In my opinion, I think AO will be designated with a new rating name like M-18, and then consoles manufactures will let games on a 'case by case' basis.
Therefore, yes, AO like games will appear eventually, but not until the AO stigma has been cast off. Games like LA Noire would fall under M-18 and thus with a few games series that were M turning M-18 the concept of the rating will force games of that type to open the way for AO games. In all likelihood ESRB, console makers and game publishers would sit down and hammer out the details of the new rating together, so nobody is caught out looking dumb. AO is obviously not working and thus ESRB will have to do something otherwise AO games will just come out unrated and that does not help ESRB at all.
It is a hot topic but either way ESRB will be caught if somehow unrated games comes out and becomes popular. The question will come up, “Why wasn’t this rated? If there was a loophole past ESRB why does it need to exist? If some publishers will not use ESRB then why isn’t ESRB improving its self so they are useful? See rated or not ESRB is holding the regulator bag when a game comes out, so they might as well find a way to rate such games in such a way as to allow them to come out above board.
